Immigration: Key considerations when recruiting from overseas

This workshop will examine, from an immigration perspective, how to recruit staff from overseas. It will be of benefit to all staff responsible for staff immigration and will be facilitated by Graeme Ross, the Immigration and Compliance Manager at the University of Cambridge, together with Simon Kenny, Principal Associate at Eversheds Sutherland. Together they will give hints and tips on how to deal pragmatically with a range of scenarios as well as highlighting relevant legal issues.

Examples of some of the areas that have been covered in previous runs include:

  • The key rules applying to Tier 2 sponsorship, including restricted and unrestricted Certificates of Sponsorship, the Resident Labour Market Test, English Language requirements, maintenance, skill level, salary rates and periods of stay.
  • Other immigration routes such as Tier 5 GAE, Tier 1 Exceptional Talent and Tier 4
  • Sponsorship requirements, such as reporting and record keeping duties
  • UKVI audits and areas of particular interest to UKVI.
  • Suspension, downgrade and revocation of sponsor licence – what does this mean and how can it be avoided?
  • Right to work checks and prevention of illegal working
  • Recent developments and Rule changes, including the healthcare surcharge.
  • The EU Settlement Scheme and the short-term impact of Brexit.

The workshop takes place on Thursday 21 November and will run between 10.30 am and 3.30 pm (registration from 10.00 am). It will be held at a central London venue.

The content will be pitched at a level that will suit both experienced practitioners and ‘new starters’, so it will serve both as a ‘health check’ for those already working in this area and as an introduction for those who are new to this area.
